Samsú Booking Terms and Conditions
1. About These Terms and Our Role
1.1 These Booking Terms and Conditions ("Booking Terms") govern all bookings made through the Samsú Platform (samsu.ie) for properties owned or managed by third-party landowners and hosts ("Owners").
1.2 The Samsú Platform is owned and operated by Samsú Samso Limited, a company registered in Ireland under company registration number 744876, whose registered address is 9 Estate Cottages, Ballsbridge, Dublin 4, D04 E0K2 ("Samsú", "we", "us", "our").
1.3 Samsú acts solely as a booking intermediary, facilitating bookings between Guests and Owners. When you make a booking through the Samsú Platform for a third-party property, you are entering into a contract directly with the Owner of that property. Your contract for the booking is not with Samsú.
1.4 As booking intermediary, Samsú's role is limited to: (a) listing properties at the request of Owners; (b) facilitating the processing of bookings and payments between Guests and Owners; (c) communicating booking confirmations and relevant information to guests; and (d) administering changes, cancellations and complaints in accordance with these Booking Terms.
1.5 Samsú accepts no liability for the acts or omissions of any Owner, or for the condition, suitability or availability of any property listed on the platform, except where expressly stated in these Booking Terms.
1.6 These Booking Terms should be read alongside our Website Terms and Conditions and Privacy and Cookie Policy, both of which are available on samsu.ie. In the event of any conflict between these Booking Terms and our Website Terms, these Booking Terms shall prevail in relation to any booking.
2. Definitions
In these Booking Terms, the following words have the meanings given below:
Booking means a reservation made by a Guest through the Samsú Platform for a stay at a Property.
Booking Confirmation means the email confirmation issued by Samsú confirming the details of a completed Booking.
Credit Note means a credit to the value stated, issued by Samsú to a Guest in the circumstances set out in clause 6, which may be redeemed against the cost of any future Booking made through the Samsú Platform. A Credit Note is valid for a period of five (5) years from the date of issue, is personal to the Guest to whom it is issued and is non-transferable, and may not be exchanged for cash.
Total Booking Fee means the total fees payable by a Guest in connection with a Booking, as displayed on the Samsú Platform at the time of booking, including the Deposit, balance payment and any applicable Extra Fees.
Deposit means the upfront payment required to confirm a Booking, equal to 25% of the Total Booking Fee, as displayed on the Samsú Platform at the time of booking. Where a Booking is made within 4 weeks of the arrival date, the Deposit shall be equal to 100% of the Total Booking Fee.
Extra Fees means any additional fees payable in connection with a Booking, including but not limited to cleaning fees, pet fees or damage deposits, as specified in the property listing.
Guest means the individual completing the booking process and named in the Booking Confirmation, who accepts these Booking Terms on behalf of all members of their party.
Owner means the third-party landowner or host who owns or manages a Property listed on the Samsú Platform.
Property means a holiday accommodation property listed on the Samsú Platform by an Owner, including all associated amenities described in the listing.
Stay means the period of occupation of a Property by a Guest and their party as specified in the Booking Confirmation.
3. Making a Booking
3.1 To make a Booking, you must be at least 18 years of age and have legal capacity to enter into a binding contract. By completing a Booking, you confirm that you meet these requirements.
3.2 When completing a Booking, you agree and warrant to Samsú and the Owner that: (a) you are at least 18 years of age and accept legal responsibility for the Booking, including payment of all Booking Fees and the conduct of all members of your party during the Stay; (b) all information provided by you during the booking process is accurate and complete; (c) the Booking is for a short-term holiday let only and you will not use the Property as a primary residence or for any business, commercial or promotional purpose without prior written consent from Samsú and the Owner; and (d) you have read and agree to comply with these Booking Terms.
3.3 A Booking is confirmed when Samsú receives payment of the Deposit (or full Booking Fees where applicable) and issues a Booking Confirmation to you by email. Please check your Booking Confirmation carefully and notify us immediately at bookings@samsu.ie if any details are incorrect.
3.4 If you do not receive a Booking Confirmation within 24 hours of completing your Booking, please contact us at bookings@samsu.ie.
3.5 Whilst we use reasonable efforts to ensure property availability information on the Samsú Platform is accurate, it is possible that your selected dates may be unavailable. In such circumstances, we may offer you alternative dates or cancel and refund your Booking in full.
3.6 Samsú and the Owner reserve the right to cancel or refuse any Booking at any time where there are reasonable grounds to believe that: (a) the Booking has been made fraudulently or in breach of these Booking Terms; (b) the Guest is likely to breach these Booking Terms; or (c) the Guest has behaved in an offensive, abusive or unlawful manner toward Samsú staff or the Owner.
4. Payments
4.1 The Deposit and Booking Fees applicable to your Booking will be displayed on the Samsú Platform at the time of booking. The Deposit, equal to 25% of the Total Booking Fee, is payable immediately upon booking. Where a Booking is made within 4 weeks of the arrival date, the full Booking Fees (100%) are payable at the time of booking.
4.2 The balance of your Booking Fees (the remaining 75% of the Total Booking Fee) will be due 6 weeks before your arrival date ("Balance Due Date"), at which point you will have paid 100% of the Total Booking Fee. You will receive a reminder approximately 7 days before the Balance Due Date. If you have not made alternative arrangements, the balance will be automatically debited from the same payment method used to pay the Deposit.
4.3 If we are unable to collect the balance payment on the Balance Due Date, we will attempt to contact you. If the balance remains unpaid within 72 hours of the Balance Due Date, we reserve the right to cancel your Booking, in which case your Deposit will be forfeited and non-refundable.
4.4 For Bookings made within 4 weeks of the arrival date, the full Booking Fees are payable at the time of booking.
4.5 Payments are processed securely through our payment processor on behalf of the Owner. Samsú does not store your payment details directly.
4.6 All Booking Fees are displayed in Euro (€). Where applicable, VAT will be included in the Booking Fees if the Owner is VAT registered.
4.7 You are responsible for ensuring that your payment details are accurate and that sufficient funds are available. Any failed payments may result in cancellation of your Booking.
5. Booking Amendments
5.1 If you wish to amend your Booking, including changing your arrival or departure dates, you must contact us in writing at bookings@samsu.ie with details of your request. Amendment requests are subject to availability and the cancellation policy set out in clause 6.2.
5.2 All amendments are subject to availability and require the consent of the Owner. Samsú cannot guarantee that any amendment request will be fulfilled.
5.3 Any difference in Booking Fees resulting from an agreed amendment will be charged or refunded accordingly.
5.4 If a date change is agreed, the cancellation policy applicable to the original Booking will continue to apply to the new dates.
6. Cancellation Policy
6.1 All cancellation requests must be made in writing to bookings@samsu.ie. Cancellations communicated by any other method will not be valid.
6.2 We understand that sometimes plans change. If you need to cancel your stay, the following terms apply:
(a) Cancellation more than 8 weeks before arrival: you will receive a full refund of all Booking Fees paid, or, if you prefer, a Credit Note to the same value.
(b) Cancellation between 4 and 8 weeks before arrival: 25% of the Total Booking Fee will be retained and the remaining balance will be refunded to your original payment method within 14 working days. Alternatively, if you prefer, Samsú may offer you a Credit Note to the full value of all Booking Fees paid in place of the refund described above.
(c) Cancellation 4 weeks or less before arrival: 100% of the Total Booking Fee is forfeited and no refund will be given, except where Samsú is able to resell the cancelled dates. Where Samsú succeeds in reselling the cancelled dates, Samsú may, at its discretion, offer you a Credit Note to the value of the amount recovered on the resale, less any difference in price and a reasonable administration cost.
(d) No-show: if you fail to check in on your arrival date without prior notice, your Booking will be treated as a cancellation within 4 weeks and 100% of Booking Fees will be forfeited.
6.3 The cancellation charges set out in clause 6.2 represent a genuine pre-estimate of the losses incurred by the Owner as a result of a cancellation, given the difficulty of reselling rural holiday accommodation at short notice.
6.4 Samsú strongly recommends that all Guests take out comprehensive travel insurance at the time of booking, including cover for cancellation and curtailment for any reason.
6.5 If extreme weather or other circumstances beyond your control prevent you from reaching the Property or completing your Stay, you remain subject to the cancellation policy set out in clause 6.2. We strongly recommend travel insurance to cover such eventualities.
6.6 The Owner may, entirely at their discretion, agree to transfer or reschedule a Booking or apply different cancellation terms. Any such agreement must be confirmed in writing by Samsú.
6.7 Where a refund is due, it will be processed to your original payment method within 14 working days. If your Booking was paid wholly or partly by gift voucher, the refund will be processed in accordance with the Gift Voucher terms set out in the Samsú Website Terms and Conditions.
6.8 Where a Booking was paid wholly or partly by gift voucher, any amount paid by gift voucher will be refunded to the original gift voucher in accordance with the Samsú Website Terms and Conditions, retaining the original expiry date of that gift voucher.
7. Cancellation by the Owner
7.1 If an Owner needs to cancel a confirmed Booking, Samsú will notify you as soon as reasonably practicable and will use reasonable efforts to offer you suitable alternative accommodation on the platform, or a full refund of all Booking Fees paid.
7.2 Neither Samsú nor the Owner will have any further liability to you where an Owner cancels a Booking, beyond the remedies set out in clause 7.1.
7.3 Where Samsú reasonably believes that an Owner is in breach of their host agreement with Samsú, or is otherwise unable or unwilling to fulfil a confirmed Booking to an appropriate standard, Samsú reserves the right to cancel the Booking on behalf of the Owner and issue a full refund to the Guest.
8. Events Beyond Our Control (Force Majeure)
8.1 Neither Samsú nor the Owner shall be liable for any failure or delay in performing obligations under these Booking Terms where such failure or delay results from any circumstance beyond their reasonable control ("Force Majeure Events"), including but not limited to acts of God, fire, explosion, lightning, storm, tempest, epidemic, pandemic, governmental measures, flood, natural disaster, accident, ionising radiation, earthquakes, riot and civil commotion, war, civil armed conflict or terrorism, industrial action, governmental or regulatory restrictions, or failure of third party services.
8.2 Where a Force Majeure Event affects the availability of a Property, Samsú will liaise between you and the Owner to arrange an alternative Booking or refund where possible.
8.3 Guests are strongly recommended to take out travel insurance that covers cancellation due to Force Majeure Events.
9. Use of the Property
9.1 Your Booking constitutes a short-term holiday let only. It does not create any tenancy or other property rights.
9.2 Check-in and check-out times will be specified in the property listing and Booking Confirmation. You must not arrive before the stated check-in time and must vacate the Property by the stated check-out time.
9.3 You must not exceed the maximum occupancy specified for the Property.
9.4 You agree, on behalf of yourself and all members of your party, to: (a) treat the Property and all its contents with due care and respect; (b) leave the Property in a clean and tidy condition; (c) follow all instructions provided by the Owner; (d) behave in a considerate and lawful manner at all times; (e) promptly notify the Owner of any loss or damage; and (f) comply with all property-specific rules as set out in the listing.
9.5 Parties, events and gatherings beyond the stated guest numbers are strictly prohibited unless prior written consent has been obtained from the Owner through Samsú.
9.6 No smoking or vaping is permitted inside any Property listed on the Samsú Platform unless expressly stated otherwise in the listing.
9.7 Pets are not permitted at a Property unless the listing expressly states that pets are welcome and you have included your pet in your Booking.
9.8 The Booking is personal to you. You may not sub-let, transfer or otherwise dispose of your rights under the Booking without prior written consent of Samsú and the Owner.
9.9 The Owner reserves the right to terminate your Stay early, without refund, if you or any member of your party behaves in a manner that the Owner reasonably considers to be inappropriate, abusive, unlawful or in breach of these Booking Terms.
10. Group Bookings
10.1 Not all Owners accept large group or party bookings, including stag parties, hen parties or similar celebratory group events. If your booking includes a group of this nature, you must confirm this with Samsú prior to booking at bookings@samsu.ie.
10.2 If a group or party booking is accepted and it subsequently emerges that the nature of the booking was misrepresented, the Owner reserves the right to refuse access or terminate the Stay, which will be treated as a cancellation under clause 6.2.
11. Damages and Losses
11.1 You are responsible for and agree to reimburse the Owner for any damage, breakage or loss caused to the Property or its contents by you or any member of your party during your Stay, beyond reasonable wear and tear.
11.2 Some Owners may require payment of a security or damage deposit prior to your Stay. Where applicable, this will be specified in the property listing.
11.3 Where damage or loss is identified after your departure, the Owner may contact you directly or through Samsú to seek reimbursement. You will be given a reasonable opportunity to respond before any charge is applied.
11.4 Samsú is not responsible for administering damage claims between Guests and Owners beyond facilitating communication between the parties.
12. Pricing and Accuracy
12.1 Prices displayed on the Samsú Platform are set by the Owner and are subject to change at any time prior to a Booking being confirmed. Once a Booking Confirmation has been issued, the price will not change.
12.2 If we identify a pricing or listing error after you have made a Booking, we will contact you as soon as possible and offer you the following options: (a) proceed with the Booking at the correct price; (b) change your dates to dates at which the original price applies; or (c) cancel the Booking with a full refund.
12.3 Property descriptions and listing information are provided by Owners. Samsú cannot independently verify every detail and accepts no liability for inaccuracies in Owner-provided content.
13. Complaints
13.1 If you have a complaint about your Stay, you should notify the Owner directly as soon as the issue arises during your Stay, to give the Owner an opportunity to resolve it.
13.2 If your complaint is not resolved by the Owner to your satisfaction, please contact Samsú in writing at bookings@samsu.ie as soon as possible and no later than 28 days after the end of your Stay. We will acknowledge your complaint within 2 working days and aim to provide a full response within 7 working days.
13.3 Samsú will use reasonable efforts to assist in resolving complaints between Guests and Owners. However, as booking intermediary, Samsú is not legally responsible for the acts or omissions of Owners.
14. Our Liability as Intermediary
14.1 As booking intermediary for the Owner, Samsú's liability to you is limited to the proper performance of our role as intermediary, which includes processing your Booking accurately, collecting and remitting payments, and communicating relevant information to you and the Owner.
14.2 Samsú is not responsible for and accepts no liability in connection with: (a) the condition, quality, safety or suitability of any Property; (b) the acts or omissions of any Owner; (c) any failure by an Owner to make a Property available as booked; (d) any loss or damage to your personal property during a Stay; or (e) any injury, illness or death arising during a Stay, except where caused by our own negligence.
14.3 Nothing in these Booking Terms excludes or limits Samsú's liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Irish law.
14.4 Subject to clause 14.3, our maximum aggregate liability shall not exceed the total Booking Fees paid by you for the relevant Booking.
14.5 Samsú shall not be liable for any indirect, consequential, special or punitive loss, including loss of enjoyment, loss of profits or business interruption.
15. Your Indemnity
You agree to indemnify and hold harmless Samsú and the Owner against all claims, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) any breach of these Booking Terms by you or any member of your party; (b) any damage caused to the Property or its contents by you or any member of your party; and (c) any unlawful or negligent act or omission by you or any member of your party during the Stay.
16. Platform Integrity
16.1 Samsú reserves the right to suspend or remove any property listing from the platform at any time where an Owner is in breach of their host agreement with Samsú.
16.2 Where a listing is removed and an active Booking exists for that property, Samsú will notify the affected Guest as soon as reasonably practicable and in any event within 24 hours. Samsú will offer the affected Guest either a full refund of all Booking Fees paid, or where possible, alternative accommodation on the platform.
16.3 Guests must not attempt to circumvent the Samsú Platform by arranging bookings or payments directly with Owners outside of the platform.
17. Data Protection and Privacy
17.1 Samsú will collect and process your personal data in connection with your Booking in accordance with our Privacy and Cookie Policy, available at samsu.ie.
17.2 By making a Booking, you consent to Samsú sharing relevant personal data with the Owner to the extent necessary to facilitate your Stay.
17.3 Samsú will not share your personal data with any third party other than the Owner and our payment processor, except where required by law.
18. Governing Law and Jurisdiction
18.1 These Booking Terms and any Booking made through the Samsú Platform are governed by Irish law.
18.2 Any dispute arising out of or in connection with these Booking Terms shall be subject to the exclusive jurisdiction of the Irish courts, subject to any mandatory consumer protection rights you may have under the law of your country of residence.
19. General
19.1 These Booking Terms constitute the entire agreement between you, Samsú and the Owner in relation to your Booking, and supersede any prior representations or agreements.
19.2 If any provision of these Booking Terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
19.3 Samsú's failure to enforce any right under these Booking Terms shall not constitute a waiver of that right.
19.4 Samsú reserves the right to amend these Booking Terms at any time. Any amendment will be posted on the Samsú Platform. Amendments will not affect any Booking already confirmed at the time of the amendment.
19.5 You may not transfer or assign your rights under a Booking without the prior written consent of Samsú and the Owner. Samsú may transfer its rights and obligations under these Booking Terms to a third party on 30 days' written notice to you.

1.1 This website, samsu.ie (the "Samsú Platform" or "Site"), is owned and operated by Samsú Samso Limited, a company registered in Ireland under company registration number 744876, whose registered address is 9 Estate Cottages, Ballsbridge, Dublin 4, D04 E0K2 ("Samsú", "we", "us", "our").
1.2 These Website Terms and Conditions ("Terms") govern your access to and use of the Samsú Platform, including all content, features and services available through it.
1.3 By accessing or using the Samsú Platform, you confirm that you accept these Terms and agree to comply with them.
2. Changes to These Terms
2.1 We reserve the right to amend these Terms at any time. Updated Terms will be posted on the Site with a revised "Last Updated" date. Your continued use of the Samsú Platform following any such update constitutes your acceptance of the revised Terms.
2.2 It is your responsibility to check these Terms periodically.
3. Accessing the Site
3.1 The Samsú Platform is made available free of charge for browsing purposes.
3.2 We do not guarantee that the Site, or any content on it, will always be available, uninterrupted, or free from errors. We may suspend, withdraw, or restrict access to all or any part of the Site at any time without notice.
4. User Accounts
4.1 Certain features, including making bookings, require you to register an account. You must be at least 18 years of age.
4.2 When registering, you agree to provide accurate, complete and current information. You must not register using false information or impersonate any other person.
4.3 Your account is personal to you. You must not share your login credentials with any third party.
4.4 You are solely responsible for all activity under your account. You must notify us immediately at bookings@samsu.ie if you become aware of any unauthorised use.
5. Acceptable Use
5.1 You may use the Samsú Platform only for lawful purposes. You must not use the Site: (a) in any way that breaches any applicable law; (b) to engage in fraudulent activity; (c) to transmit unsolicited advertising; (d) to upload harmful code; (e) to gain unauthorised access; (f) in any manner that could damage or impair the Site; (g) to harvest personal data without consent; (h) to scrape, copy or re-sell content; or (i) in any way harmful to minors.
6. Content on the Site
6.1 The Samsú Platform contains content provided both by us and by third parties. While we make reasonable efforts to ensure content is accurate, we do not warrant that all content is complete, accurate or free from errors.
6.2 Content is provided for general information purposes only and does not constitute professional advice.
6.3 If you submit content to the Site, you warrant that: (a) you own or have the right to submit such content; (b) the content is accurate and not defamatory or unlawful; and (c) the content does not infringe third party rights.
6.4 By submitting User Content, you grant Samsú a non-exclusive, royalty-free, perpetual, worldwide licence to use, store, reproduce, modify, publish and distribute that content.
7. Reviews Policy
7.1 All reviews must reflect the genuine experience of the person submitting them.
7.2 You must not submit a review that is false, fabricated, incentivised, or submitted on behalf of another person.
7.3 Reviews must not contain defamatory, discriminatory, offensive or otherwise unlawful content.
7.4 We reserve the right to remove reviews that violate this policy.
8. Intellectual Property
8.1 The Samsú Platform and all content on it is owned by or licensed to Samsú and is protected by Irish and international intellectual property law.
8.2 You may view and print pages from the Site for your own personal, non-commercial use only. You must not modify, copy, reproduce, republish, upload, transmit, distribute or commercially exploit any content without prior written consent.
9. Third Party Links
9.1 The Samsú Platform may contain links to third party websites or services. We have no control over their content and accept no responsibility for them.
10. Gift Vouchers
10.1 Samsú gift vouchers are available for purchase through the Site. Gift vouchers are valid for 5 years from the date of purchase and must be redeemed in a single transaction unless otherwise stated.
10.2 Gift vouchers have no cash value and cannot be exchanged for cash. Lost, stolen or expired gift vouchers cannot be replaced or refunded.
10.3 Gift vouchers may be used toward bookings on the Samsú Platform subject to availability.
10.4 Refunds in connection with gift voucher bookings are handled as follows: (a) Where the guest cancels: any refund due will be calculated in accordance with our Booking Terms. Where the booking was paid wholly or partly by gift voucher, the amount paid by gift voucher will be credited back to the original gift voucher, and the original expiry date will continue to apply. (b) Where Samsú or the Owner cancels: the guest is entitled to a full cash refund to their original payment method. (c) Where cancellation results from circumstances beyond reasonable control: Samsú will offer the guest a choice between a full gift voucher to the value paid or a cash refund where reasonably practicable.
11. Limitation of Liability
11.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Irish law.
11.2 Subject to clause 11.1, Samsú shall not be liable to you for any loss or damage arising out of or in connection with your use of the Samsú Platform.
11.3 We shall not be liable for any indirect, consequential, special or punitive loss, including loss of profits, loss of data, loss of goodwill or business interruption.
12. Governing Law and Jurisdiction
12.1 These Terms are governed by Irish law.
12.2 The courts of Ireland shall have exclusive jurisdiction to resolve any dispute arising out of or in connection with these Terms, subject to mandatory consumer protection rights.
